JOHANNESBURG - President Cyril Ramaphosa has signed three bills into law this month, just ahead of elections.
But The Regulation of Interception of Communications and Provision of Communication-related Information Act which was passed by the National Assembly in November last year, still remains in the wind.
While the bill includes necessary fixes, such as post-surveillance notification and enhanced judicial oversight, it overlooks significant issues like the Section 205 loophole in the Criminal Procedure Act, which allows surveillance without RICA safeguards.
Privacy advocates argue that without closing these gaps, the amendments fail to fully protect against state surveillance abuses.
