Discussion | Freedom Under Law comments on Hlophe ruling

JOHANNESBURG - What happened on Friday is effectively an interim or temporary order. 

Impeached Judge President John Hlophe has been barred from taking part in any activities of the Judicial Service Commission or JSC, pending a review of the National Assembly’s decision to designate him to the body.

Early this month the Democratic Alliance, Corruption Watch and Freedom Under Law applied for the order to stop him taking part in upcoming interviews at the JSC in October.

The second part of their application calls for a full review of the National Assembly’s decision to appoint him to the commission.

Hlophe was removed from the bench by the National Assembly following a JSC process that found him guilty of gross misconduct for trying to sway two Constitutional Court judges to rule in favour of former President and now MK President, Jacob Zuma, in the arms deal corruption case.

Hlophe was sworn in as a member of Parliament for the MK Party in June and was nominated by that party to sit on the very same JSC.
