CAPE TOWN - Former Western Cape Judge president John Hlophe will appeal his impeachment.
His lawyer Thabani Masuku says they're studying the ruling, and intend to challenge it.
Hlophe is in court this time, because the Democratic Alliance is challenging his nomination, to serve on the Judicial Services Commission, the very same body that impeached him.
Advocate Dali Mpofu says the separation of judiciary and parliamentary powers is very important in a constitutional democracy.
Defending John Hlophe, Mpofu says courts should not be used as an appeal tribunal for decisions that should be taken in parliament.
Legal expert Richard Chemaly says even if the DA wins their case, it won't mean that parliament will bar the disgraced former judge from sitting on the Commission.
