JOHANNESBURG - The MK Party has told the High Court in Johannesburg that excluding John Hlophe from the Judicial Service Commission next sitting would be unconstitutional.
Hlophe was removed from the bench by the National Assembly following a JSC process that found him guilty of gross misconduct.
He’s since been sworn in as a member of Parliament for the MK Party in June and was nominated by that party to sit on the very same JSC.
But the DA and others approached the courts arguing it was irrational for him to serve on the same body that recommended his impeachment and disciplines members of the judiciary.
As an interim order the lower court excluded Hlophe from the first sitting while the merits of the case are still to be considered.
Now that is being contested.
