JOHANNESBURG - The National Prosecuting Authority has filed an appeal in the R24,9-million Nulane Investments judgment.

Five of the six accused had successfully applied for the matter to be discharged.

The matter included former government officials and associates of the Gupta brothers.

It is related to a multi-million-rand tender awarded to Nulane Investments to conduct a feasibility study.

That tender is believed to be the forerunner of the controversial R200-million Estina Dairy Farm project.

In February, the High Court in Bloemfontein dismissed most of the state's evidence, ruling it inadmissible in court.

The NPA believes acting Judge Nompumelelo Gusha erred in his judgment.
