JOHANNESBURG - A small victory for rape survivors after the High Court in Pretoria declared sections of the Sexual Offences Act unconstitutional.
A rape survivor, The Embrace Project and the Centre for Applied Legal Studies approached the court to challenge loopholes in the act.
Specifically, they challenged complexities around the definition of consent in sexual offences cases, which they argued had resulted in the acquittal of some accused.
